Terms and Conditions
These Terms and Conditions govern your use of TourAlbania.al and the services provided by Tour Albania (“Company,” “we,” “our,” “us”). By booking a tour or using our services, you agree to comply with these Terms and Conditions.
1. Definitions
• “Client” or “You” refers to any individual or group that books or uses our services.
• “Tour Guide” refers to a professional guide assigned to lead a group.
• “Booking Confirmation” refers to an official email or document confirming your reservation.
• “Force Majeure” refers to unpredictable and uncontrollable events (e.g., natural disasters, government actions, pandemics, etc.).
• “Health and Safety Laws” refer to the relevant Albanian legislation governing occupational and recreational safety.
2. Booking and Payment Policy
2.1 Booking Process
• A booking is confirmed only when the Client receives a written confirmation email.
• A deposit of 15% of the total tour price is required to secure your reservation.
• Full payment must be made no later than 45 days before the tour starts.
• For tours shorter than three days, the full payment must be made at least 20 days before the tour.
• Late payments may result in automatic cancellation without refund.
2.2 Payment Methods
• Payments can be made via bank transfer, PayPal, or cash upon agreement.
• All prices are in EUR (€) unless otherwise stated.
3. Cancellation and Refund Policy
3.1 Cancellations by Client
• More than 45 days before departure: Full refund minus transaction fees.
• Between 35 and 45 days before departure: 80% refund.
• Between 25 and 35 days before departure: 50% refund.
• 7 days or less before departure: No refund.
• If a Client is unable to participate due to force majeure, we will issue a credit valid for 12 months.
3.2 Cancellations by TourAlbania.al
• We reserve the right to cancel any tour due to insufficient participants, adverse weather, or other factors beyond our control. In such cases, we will offer a full refund or an alternative tour.
• We are not liable for any additional expenses (e.g., flight cancellations, hotel costs, etc.).
4. Safety, Health, and Liability
4.1 Health and Fitness
• Clients must be physically and mentally fit for the activities they book.
• It is the responsibility of each Client to inform us of any medical conditions before booking.
• TourAlbania.al reserves the right to refuse participation if a Client’s condition poses a risk to themselves or others.
4.2 Travel Insurance
• Clients must purchase comprehensive travel insurance that covers medical emergencies, trip cancellations, and personal liability.
• TourAlbania.al is not liable for injuries, damages, or losses incurred during the tour.
4.3 Waiver of Liability
By accepting our Terms and Conditions, Clients acknowledge and agree to the inherent risks involved in tours (e.g., hiking, rafting, off-road driving). They understand that these activities may involve accidents, falls, natural disasters, and other unforeseen circumstances. Clients release TourAlbania.al from any liability arising from their participation in these activities.
Waiver Statement:
“I acknowledge that I have voluntarily chosen to participate in the activities arranged by TourAlbania.al. I understand that these activities involve inherent risks, including but not limited to accidents, falls, natural disasters, and other unforeseen circumstances. I release TourAlbania.al from any liability arising from my participation in these activities.”
5. Tour Modifications and Changes
5.1 Changes by the Client
• Requests for itinerary changes must be submitted in writing at least 30 days before departure.
• Additional costs may apply based on changes requested.
5.2 Changes by TourAlbania.al
• We reserve the right to modify tour itineraries due to weather conditions, government restrictions, or safety concerns.
• We will notify Clients of significant changes and offer alternatives if applicable.
6. Code of Conduct
• Clients must respect local customs, wildlife, and cultural sites.
• Clients must follow instructions from tour guides and safety personnel.
• Disruptive or dangerous behavior may result in removal from the tour without refund.
7. Complaints and Dispute Resolution
• If you have a complaint, please notify your tour guide or contact us at [insert contact email].
• We will investigate complaints and aim to resolve them within 14 days.
• Any disputes arising under these Terms shall be governed by the laws of Albania.
8. Privacy Policy
• We collect personal data to process bookings and provide services.
• We do not share or sell your data without consent, except as required by law.
9. Governing Law
These Terms are governed by the laws of Albania. Any legal action shall be brought before Albanian courts.
10. Agreement
By booking a tour with TourAlbania.al, you acknowledge that you have read and agreed to our terms and conditions.
